Hanson R. Tipton elected to TBA YLD Fellows

Hanson R. Tipton was recently elected a Fellow of the Tennessee Bar Association Young Lawyers Division during the association’s annual convention this month in Chattanooga.

The TBA YLD Fellows was founded to promote the objectives of the YLD and to encourage young lawyers to be active in the TBA. New members are invited to join the organization based on their involvement with and commitment to the YLD while they were young lawyers. The Fellows organization meets annually during the TBA’s summer convention to elect officers and induct new members.

Jon Roach rated Preeminent lawyer by Martindale-Hubbell

Jon G. Roach has been rated as a Preeminent lawyer by Martindale-Hubbell. The AV rating is the highest rating a lawyer can achieve. Reviews occur in stages over the course of a lawyer's career typically after a United States or Canadian lawyer has been admitted to a state or provincial bar for 10 years or more. Personal interviews are conducted by LexisNexis Martindale-Hubbell representatives, confidential questionnaires are distributed and, at times, lawyers under review may be asked to provide professional references to assist with the process.

7th Annual Wesley House Golf Tournament

Donations from the tournament help with tutoring lessons for inner-city youth, as well as life skills and mentoring. Wesley House Community Center offers an after school learning program for children in grades 1-5, summer program, performing arts and cultural education, and senior care for the community's elderly

Hanson Tipton speaks at KBA seminar

On April 8, 2010, Hanson R. Tipton spoke at a Knoxville Bar Association CLE titled “Race to the Future: The Changing Legal Marketplace.”  Mr. Tipton was on a panel that spoke about topics such as the pressures of meeting billable goals, climbing the firm ladder, and gaining/retaining/pleasing clients. The panel addressed how the legal services marketplace is undergoing tremendous upheaval from a wide range of sources, including the economic crisis, the emergence of non-lawyer competitors, and a massive generational shift. Nathan Rowell selected by Tennessee Bar Foundation

Nathan D. Rowell has recently been elected a Fellow of the Tennessee Bar Foundation, an association of 730 attorneys across the state.  Invitations to membership, which is a position of honor, were extended to 35 attorneys this year by the Board of Trustees.  The introduction of new Fellows took place at the annual Fellows' Dinner in Nashville. 

The Bar Foundation's purpose is two-fold: to honor attorneys who have distinguished themselves in the profession and to administer a grant making program.  That project, known by its acronym “IOLTA” (Interest On Lawyers' Trust Accounts), has awarded grants in excess of $17,000,000 to law-related, public interest projects throughout Tennessee.

Nathan Rowell elected to Wesley House Board

Nathan Rowell has been elected Vice President of the 2011 Board of Directors for Wesley House Community Center.  The Board of Directors consists of at least 18 volunteers from throughout Knoxville who serve for 3 year terms.  Wesley House Community Center offers an after school learning program for children in grades 1-5, summer program, performing arts and cultural education, and senior care for the community's elderly.

On December 3, 2010, Watson, Roach, Batson, Rowell & Lauderback attorney Hanson R. Tipton participated in “Ethics Bowl IV,” an entertaining and enlightening ethics seminar produced by the Knoxville Bar Association and conducted in a “scholars bowl” competition format. The theme of this year’s Ethics Bowl was “Family Feud,” and teams were made up of KBA lawyers and judges who were related to each other.  Hanson’s teammate was his father, The Hon. Joseph M. Tipton.

Firm helps sponsor charity tennis tournament

Watson, Roach, Batson, Rowell & Lauderback, PLC is pleased to be a sponsor of The Knoxville Challenger, which will return to Knoxville on November 9 – 14, 2010 and will be played at the Knoxville Racquet Club’s indoor tennis facility.

The Challenger Series is a part of the USTA’s Pro Circuit series which host national and international players and take place all around the globe, typically including players ranked between 75 and 250 in the world.

The proceeds of the Knoxville Challenger event this year will benefit The Helen Ross McNabb Center, a regional not-for-profit organization that provides quality and compassionate mental health care, addiction recovery and social services to those in need within the Knoxville community. The event will also honor the memory of the late Harry W. Stowers, co-founder of Stowers Machinery Corporation, the Caterpillar dealer in East Tennessee, whose passion and commitment for The Center was displayed in fundraising for The Center from 1987 until his death in 2007.

Sixth Circuit Court of Appeals reverses District Court in Spears v. Ruth

On December 10, 2009, the Sixth Circuit Court of Appeals reversed the holding of the United States District Court for the Eastern District of Tennessee at Chattanooga, finding no constitutional violation occurred in the case of Spears v. Ruth, 589 F.3d 249 (6th Cir. 2009).

In Spears, the Plaintiffs alleged the defendant police officer was deliberately indifferent to the medical needs of the decedent plaintiff, who ultimately died due to cocaine intoxication. Both the individual defendant police officer, as well as the City of Cleveland, Tennessee, were sued by Plaintiffs under a deliberate indifference to medical needs theory pursuant to 42 U.S.C. 1983 and the Fourteenth Amendment to the United States Constitution. The defendants filed a motion for summary judgment on that issue which was ultimately denied by the United States District Court for the Eastern District of Tennessee at Chattanooga.

On appeal, the Sixth Circuit Court of Appeals held that no such constitutional violation occurred in that the defendant officer's actions did not constitute deliberate indifference. Further, the Sixth Circuit held that City policies were not causally related to any constitutional injuries. The Sixth Circuit therefore reversed the holding of the District Court, instructing the District Court to enter judgment on behalf of the individual defendant officer and the City of Cleveland, Tennessee.
